Anti-Corruption Laws

Thailand has enacted a variety of laws dealing with corruption and ethical standards in the public sector.  The laws applicable to foreigners, foreign entities, or other corporate vehicles with a foreign shareholding include the Thai Penal Code, the regulations concerning public procurement, corporate governance rules and legislation.  The National Anti‐Corruption Commission was established as an independent agency with broad powers of investigation and has the authority to independently initiate prosecution.

We routinely advise clients on this evolving area of Thai law.  We are also one of the few local firms which regularly advises clients on the U.S. Foreign Corrupt Practices Act and the OECD Convention on Combating Bribery of Foreign Public Officials in International Business Transactions, and we keep track of similar legislative developments in other countries which are major sources of direct foreign investment into Thailand.
